AYITI Gallery provides an online service for artists to show and sell their artworks, and for art lovers and companies to browse and purchase quality original artworks through our website www.ayitigallery.com. AYITI Gallery also allows artists, art professionals, art lovers, collectors and patrons to post and connect with each other.

 

AYITI Gallery reserves the right at any time to modify these terms without notice. Users of our website will be informed accordingly by accessing this page which will be updated with the latest version. Please make sure that you read and understand these terms before ordering any products from our website.

 

These terms, with the terms of use, the delivery/return policy and the privacy policy constitute a binding legal agreement between you and AYITI Gallery. You (or the entity you represent) agree that by using any of our online services (incl. purchasing, posting, connecting…) you are bound to these terms whether or not you have registered an account with us.

 

These terms are governed by English laws and any breach of these terms will be referred to those.

TERMS OF USE

 

To purchase an artwork online or to become a member you agree to provide accurate information. AYITI Gallery reserves the right to terminate the purchase process or any membership if any information provided on your account are suspected to be false or if any information shared on our forum seem abusive.  

 

Once you register as a member on the platform you agree that you will not contact the artist with respect to purchasing directly from him/her or by any other channels. AYITI Gallery reserves the right to ban you if it appears that your sole goal is to approach artists to buy artworks directly from them or via another channel.

 

AYITI Gallery owns the entire content of the website including graphics, images and texts. All content is protected by copyright and English laws. To copy any of the content, the user must address a formal demand to AYITI Gallery. Any commercial use and duplication of the website content and its trade name are strictly prohibited. The purchase of any artwork does not provide you with any copyright interest or intellectual property right. If you want to use the copyright, you shall address us a formal demand that will be subject to deliberation.

 

When creating an account for personal use, you agree that you will not, nor allow anyone else, use your account to disrupt, damage or interfere our services and its use by our members.

 

We will not be liable for any damages or losses of any kind arising from the use of the website and the purchase of the artworks.

 

We only supply artworks for domestic and private use. You agree not to use the artworks for commercial, business and re-sale purposes.

 

You agree not to post, upload or publish any misappropriate or offensive content. AYITI Gallery reserves the right to ban you if it appears that your action aims at discrediting AYITI Gallery and its members or aims at disrupting its online services. AYITI Gallery reserves the right to investigate and prosecute violations in regard to the above and its extension.

 

You agree to hold AYITI Gallery and its affiliates, harmless from and against any claims, liabilities, damages, losses and expenses, arising from your access to our site and online services.

 

We attempt to describe the artworks as accurately as possible. However, we do not warrant that artwork descriptions or other content of the website are 100% accurate, complete, reliable, current or error-free.

 

We are not liable for any financial damage (including but not limited to the cost of any replacement purchase) that may occur because of non-timely arrival or any lack of availability or conformity of the artwork.

 

We cannot guarantee the continuous, uninterrupted or error-free operability of the website. We will not be liable for any unavailability, modification, suspension, or any malfunctioning features, parts or content of the website.

 

 

 

DELIVERY/RETURN POLICY

 

AYITI Gallery plays the role of intermediary between the artist and you. When you buy an artwork through our website, you purchase the artwork from AYITI Gallery. Once the payment is processed to us and delivery information given by you, the artist will ship the artwork to you. In some cases (especially for artists we directly represent), we will ship the artwork to you when it is already in our possession. From that moment you become the sole owner of the artwork. The artist or we are responsible for safely packaging, insuring and shipping the artwork. Any shipping will be provided with a tracking number.

 

Once the artwork is delivered to your destination, AYITI Gallery decline any responsibility. From that date you have 7 days to return the artwork if you wish so. Within that period, you will either be proposed a replacement or receive a full refund once the artwork is sent back and received. If you change your mind, return shipping costs will be covered by you. If the artwork is faulty or not as described, AYITI Gallery will cover the return shipping costs. Returns will be shipped back to the artist when feasible or to AYITI Gallery. You must contact us before returning the artwork. You must return the artwork as it was when you received it (unused condition), send it in its original packaging and provide a tracking number. After 7 days we will consider that the transaction is concluded, and payment will be sent to the artist.

 

If we notice any error from us or from you within the purchasing process, we reserve the right to refuse or cancel any order and the full payment will be refunded to you without any charges.

 

We warrant for a period of 1 month that the artwork shall be free from material defects i.e. any fair wear and tear, damage, abnormal storage or manipulation conditions, accident, negligence, alteration or repair from you or any third party.

 

We deliver worldwide. However there might be restrictions on some products in some countries. If you are aware of those please contact us before ordering. In some countries, you may be subject to import duties and taxes that will be complied and covered by you. We will not be liable or responsible if the artwork is retained in customs.

 

 

 

PRIVACY POLICY

 

AYTI Gallery respects and protects your privacy. By providing any personal and non-personal information to AYITI Gallery, you grant us the right to process this information for internal purposes such as fulfilling an order, providing a better customer support and upgrading our services.

 

Personal data are either collected from you or provided by you (when registering as a member or placing an order or submitting a form or subscribing to the newsletter).

 

AYITI Gallery will never share voluntarily your information to a third party without your consent.

 

By providing your email address you consent us to contact you and send you notifications or information regarding our services and offers. At any time you can opt out from our communications.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. We do not collect nor store your credit card information.

 

The transmission of information via the internet is never completely secure. Though we do our best to secure your data, we cannot guarantee the security of the data transmitted through our website. You accept that transmission of your personal is done at your own risk.

 

If you choose to display personal information on the website visible to other users (i.e. via forum), you accept that you do so at your own risk.
